Suppose some malicious person came along and removed all the lug nuts from
your neigbours car. Not noticing, he drives away, a wheel falls off, he
can't steer and so he smashes into your car as a result causing $10,000 of
damage...
* You could certainly sue the vandal...and that's true in this case too.
* You could probably sue your neighbour for not checking the lug nuts on
his car before he drove off...but that's a bit of a stretch.
* But trying to sue General Motors for not having vandal-proof lug-nuts
isn't going to work. Even though there exists locking lug nuts.
Don't get me wrong - I believe completely that this is 100% Microsoft's fault,
they could have easily avoided it and they are MORALLY responsible. But whether
they can be held LEGALLY responsible - well, I doubt it.
