IANAL either, but if the Device had a GPL license, the above would be
true.

The EULA does not specify the type of license that the Device must
have.  If it had said "must have a Microsoft approved license" and
enumerated the types of licenses it expected, then that would hold up in
court, otherwise, its too vague to mean anything.
