According to SCO's latest investor information, they
are currently profitable, but that includes the money
that M$ has given them. Without that money, they
would still be in the red. I don't think that many
people are fooled by M$ "license" agreement at all.
Since lawsuits take time, the hope for them as Tom
mentioned is that Linux loses traction while they gain
it back.
SCO's latest mistake in this fiasco was threatening
Novell with their FUD letter. They forced Novell to
reveal that "they" still own the copyrights and
patents.
Although SCO now claims it's about trade secrets and
breach of contract, it further degrades their claims.
Before they tried to disguise their position by trying
to represent Unix. Now they have to narrowly attack
IBM on trade secrets and code of OpenServer and
UnixWare.
I wasn't around for the USL vs BSD lawsuit in 1992,
but doesn't this seem like the same lawsuit with a new
target. In that case, USL had to settle that BSD
would remove 9 files in exchange that BSD would not
countersue USL for copying tons of BSD code. If
anything, it would ironic if SCO was suing IBM for
that same code.
