The Open Group has problems with Apple's use of the term UNIX. Apple didn't bother to get their product UNIX Certified.
To build on that a little, under the terms of the agreement that they have with the real owners of UNIX [the open group], SCO's case falls apart. Linux prevails.
Oh, did I forget to mention that? Or that IBM purchased it's perpetual license from OSF which later merged with the Open Group. I may have also forgot to mention that I worked on OSF AIX at IBM and edited the AIX API reference manual in 1994.
I recommend against making any wagers that SCO owns the code IBM contributed to Linux.
